About the platform
Marine Scrap Africa is a marketplace operated by MSA Green Technologies Limited, a company registered in Nigeria (referred to in these terms as "we", "us", or "MSA"). The platform is accessible at marinescrap.africa and related subdomains.
The platform facilitates the listing, discovery, and transaction of marine scrap, end-of-life vessels, and offshore equipment. We are an intermediary. We do not buy or sell assets directly, and we are not a party to transactions between users.
Who can use the platform
By using the platform, you confirm that you are:
- at least 18 years of age
- legally capable of entering into binding contracts under the laws of your jurisdiction
- accessing the platform for lawful purposes related to the buying, selling, or evaluation of marine or industrial assets
If you are registering on behalf of a company or organisation, you confirm that you have authority to bind that entity to these terms.
We reserve the right to refuse access or suspend accounts at our discretion, including where we have reason to believe a user is acting in bad faith or in violation of these terms.
Accounts and registration
To list assets or contact sellers, you must create an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information when registering. If any of your information changes, you must update it promptly.
You must not share your account credentials, impersonate another person, or create accounts for deceptive purposes. We may suspend or terminate accounts that breach these obligations.
Listings
Sellers are responsible for ensuring that all listing information is accurate, complete, and not misleading. This includes descriptions, photographs, specifications, condition, location, and pricing.
All listings are reviewed before being made public. We reserve the right to reject, remove, or request changes to any listing that:
- contains false, misleading, or incomplete information
- relates to an asset the seller does not have the right to sell
- violates applicable law or regulation
- breaches these terms or our community guidelines
Approval of a listing does not constitute verification of the asset, its condition, or the seller's title to it. Buyers are responsible for conducting their own due diligence.
Sellers must not include contact information such as phone numbers, email addresses, or social media handles in listing descriptions, messages, or negotiation notes. Communication must take place through the platform.
Transactions and deals
The platform provides a structured environment for buyers and sellers to agree on terms and complete transactions. We facilitate this process but are not a party to any transaction.
Once a deal is agreed between a buyer and seller and proceeds through the platform's deal flow, both parties are bound by the terms they have agreed. Any disputes arising from a transaction are between the buyer and seller.
Where escrow or structured settlement is used, additional terms specific to that arrangement will apply. These will be presented to both parties before any payment is made.
We are not responsible for the quality, safety, legality, or fitness for purpose of any asset listed or transacted on the platform. We are not liable for losses arising from a failed, disputed, or fraudulent transaction.
Fees and commissions
We earn revenue through commissions on successfully completed transactions. The applicable commission rate will be communicated before a deal is finalised. Commissions are typically deducted from the amount held before funds are released to the seller.
Listing on the platform is currently free. We reserve the right to introduce fees for listings or additional services in the future. Any changes to our fee structure will be communicated to registered users with reasonable notice before taking effect.
All fees are non-refundable unless we have failed to deliver a service as described.
Prohibited conduct
You must not use the platform to:
- post false, misleading, or fraudulent listings or communications
- attempt to conduct transactions outside the platform to avoid fees or accountability
- harass, threaten, or abuse other users
- share, solicit, or use personal contact details in platform messages or listings
- introduce malware, spam, or any harmful content
- scrape, copy, or reproduce platform content without permission
- violate any applicable Nigerian law or the laws of the jurisdiction in which you operate
- impersonate any person, company, or authority
Breaching these provisions may result in immediate suspension or permanent removal from the platform, without prejudice to any legal remedies available to us.
Intellectual property
All content on the platform that is not user-generated, including the design, branding, code, text, and structure, is the property of MSA Green Technologies Limited and is protected by applicable intellectual property law.
By uploading photographs, descriptions, or other content to the platform, you grant us a non-exclusive, royalty-free licence to display and use that content in connection with operating and promoting the platform. You retain ownership of your content.
You must not upload content that infringes the intellectual property rights of any third party.
Privacy and data
Your use of the platform is also governed by our Privacy Policy, which sets out how we collect, use, and protect your personal data. By using the platform, you agree to the terms of that policy.
We take reasonable steps to protect the security of your data, but we cannot guarantee that any transmission over the internet is entirely secure. You use the platform at your own risk in this respect.
Limitation of liability
To the fullest extent permitted by law, MSA Green Technologies Limited is not liable for:
- any loss arising from a transaction between users of the platform
- inaccurate or incomplete listing information provided by sellers
- loss of business, revenue, data, or profits
- interruptions to or unavailability of the platform
- any indirect or consequential loss of any kind
Where liability cannot be excluded by law, our total liability to you in connection with the platform is limited to the fees, if any, you have paid to us in the three months preceding the event giving rise to the claim.
Dispute resolution
If you have a complaint or dispute with us, please contact us at in the first instance. We will make reasonable efforts to resolve the matter informally.
Disputes between buyers and sellers on the platform are the responsibility of those parties. We may, at our discretion, assist in facilitating communication but we are not an arbitrator and our involvement does not create liability on our part.
Any disputes that cannot be resolved informally will be subject to the jurisdiction of the courts of Nigeria.
Changes to these terms
We may update these terms from time to time. Where changes are material, we will notify registered users by email or through the platform before they take effect. The date at the top of this page reflects the most recent update.
Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
Governing law
These terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Nothing in these terms affects any rights you may have under applicable consumer protection law in your jurisdiction.
